IC Care Privacy Policy

「IC Care」係由慷驊股份有限公司所營運，依據 IC  Care 使用條款提供使用者健康管理服務及數位資訊服務之平台。

IC Care對使用者個人資料的蒐集、處理及利用均應遵守中華民國（臺灣）之「個人資料保護法」及相關法令規範。於使用者加入IC Care 會員或使用IC Care相關服務時，本平台系統將依使用者所要求的服務內容，向使用者取得該服務所必須蒐集、處理及利用之可供辨識個人之資料。若使用者不同意提供個人資料，請勿繼續使用 IC Care 服務。

為保護使用者的隱私權，請使用者詳細閱讀以下有關 IC Care 之隱私權保護條款（下稱「本隱私條款」）。為保護使用者之個人資料，IC Care 有權隨時修改並更新本隱私條款。

若使用者未滿 18 歲（或依該未成年人居住國家或地區法令規定之成年年齡），請勿在未經父母或法定代理人同意之情況下，使用本平台系統或通過其任何功能提供任何個人資料。

本隱私條款未定義之用語，均依據「IC Care 使用條款」之約定及定義。

一、個人資料蒐集、處理及利用之合法依據

本平台系統係依據個人資料保護法第19條，向使用者蒐集、處理及利用個人資料。

二、個人資料之種類

In accordance with the "Specific Purpose and the Classification of Personal Information of the Personal Information Protection Act" issued by the Ministry of Justice, the categories of user data collected, processed and used by IC Care are listed below.

三、個人資料之蒐集方式

IC Care may obtain personal data through the following means:

  1. 直接由使用者向 IC Care 提供資料，包括使用者使用 AI Care 健康管理人工智慧軟體等IC Care服務時提供之資料；
  2. 經由第三方服務提供者，包括使用者使用第三方服務時所提供之資料；
  3. 本平台系統會蒐集使用者於本平台系統活動的資訊，並通過追蹤技術（例如 cookie）自動蒐集使用者之資料；及
  4. IC Care may further analyze and obtain information about users from the information collected, processed and used by IC Care.

四、個人資料之蒐集、處理及利用之目的

IC Care 為提供及優化本平台系統之服務，使用者同意，就其提供予本平台系統的資訊及個人資料，IC Care有權進行下列處理及利用：

  1. 提供IC Care服務及第三方服務，及營運、維護、監督、管理及增強 IC Care 的產品、服務、內容及網站，包括監控及分析網站內容的有效性；
  2. 向潛在使用者宣傳及營銷 IC Care；
  3. 履約及遵循相關法令規定及法院或行政機關之命令及法律程序；
  4. To verify use, detect potential fraud or wrongdoing and otherwise maintain the security of the Platform and user data.
  5. 協助 IC Care 開發、交付及改進本平台系統及 IC Care 的產品、服務及內容；包括但不限於，IC Care有權使用人工智慧軟體（如AI Care）對使用者之資訊進行分析及研究，使用者提供之資訊及個人資料有可能用於訓練、改善及優化人工智慧軟體；
  6. To conduct academic research and other consulting and advisory services; and
  7. For any other purposes as agreed to by the user.

In accordance with the "Specific Purpose and the Classification of Personal Information of the Personal Information Protection Act" promulgated by the Ministry of Justice, the specific purposes for which the Platform collects, processes, uses and retains Users' personal data are listed below:

五、個人資料之揭露

  1. 於法令規定許可之範圍內，使用者可能會經由本平台系統向第三方服務提供者取得第三方服務。為提供第三方服務，使用者明確同意本平台系統得將使用者之個人資料，於依據本隱私條款授權處理及利用之範圍內，傳輸至其關係企業及/或第三方服務提供者。
  2. 本平台系統提供資料予第三方服務提供者及其他第三人，應遵守個人資料保護法及相關法令規定。

六、個人資料之保存、修改及刪除

  1. 使用者提供之個人資料，本平台系統將於會員帳戶存續期間內持續保存，直至使用者刪除會員帳戶，或當使用者依本隱私條款或相關法令規定要求修改或刪除時為止。
  2. IC Care採取之安全措施旨在防止個人資料經由意外、非法或未經授權的破壞、丟失、更改、存取或揭露，惟 IC Care 無法保證網路傳輸資訊的安全性，且使用者應自行負責保管其會員帳戶資訊。
  3. 使用者有權隨時修改及刪除其個人資料。依個人資料保護法第 3 條規定，除非有其他法令限制，使用者就其所提供之個人資料，享有查詢或請求閱覽、請求製給複製本、請求補充或更正、請求停止蒐集處理或利用（包含撤回同意、反對本平台系統繼續處理使用者的資料）及請求刪除的權利。惟，若使用者現正使用本平台系統之相關服務，於法令規定容許之範圍內，使用者曾提供予 IC Care 個人資料之蒐集、處理及利用其個人資料之授權及同意，於使用者使用本平台系統相關服務之期間內仍為有效。若使用者撤回對個人資料某些用途的同意或授權，IC Care 可能無法再提供本平台系統之全部或部分服務。
  4. If the User wishes to inquire or request access to the personal data provided by them, to request the creation of copies, to request additions or corrections, to request the cessation of collection and processing or use (including withdrawal of consent and objection to the continued processing of users' data by the Platform), and to request deletion of personal data, the User should send their written request to the service mailbox of the Platform at "service@iccare.vip」或本平台系統營運公司慷驊股份有限公司之地址，經本平台系統確認該個人資料為使用者所有，本平台系統將依相關法律於合理期限內回應並處理使用者之請求。

七、個人資料的國際傳輸及儲存

To the extent permitted by law, the user expressly agrees that IC Care and the Platform have the right to transfer and store the user's personal data internationally outside of Taiwan.

八、使用第三方平台註冊會員帳戶

本平台系統可能包含允許使用者利用其他第三方網站或平台（例如，社交媒體網站、 Google 網站、LINE 應用程式，合稱「第三方平台」）之會員帳戶，連結本平台系統及快速註冊本平台系統之會員帳戶，允許使用者直接使用第三方平台之帳戶訪問及使用本平台系統之各項功能及服務（下稱「快速註冊」）。若使用者使用快速註冊，使用者同意，(a)IC Care無從控制第三方平台是否或如何蒐集或使用使用者的個人資料，(b)使用者將授權本平台系統自第三方平台蒐集使用者的個人資料，及(c)使用者發布或以其他方式提供予本平台系統的資訊及個人資料可能會被該第三方平台蒐集、利用或公開顯示。
